Your order will not be accepted until Atelier Silver Mouse confirms its acceptance. Before accepting your order, we must receive and process your payment. Please review your order carefully before submitting it, as Atelier Silver Mouse may not be able to accommodate cancellation requests once the order has been accepted. If your order is rejected, changed, or canceled, we will notify you using the email address, billing address, and/or phone number provided at the time the order was placed.

SECTION 4 — PRICES AND BILLING

It will be stated in the order confirmation email. Prices in the store are displayed in the currency indicated in the store and include VAT where applicable. Delivery costs are shown during checkout before the order is confirmed. Delivery times are estimates only. We will exercise due care to ensure that shipment and delivery take place within the declared time, however delays beyond our control may occur (for example on the part of the carrier or customs clearance). The above does not limit the Consumer’s statutory rights in the event of delay in performance of the contract. For consumers, the risk of accidental loss of or damage to the goods passes to the Customer when the goods are taken into possession by the Customer or a third party indicated by the Customer other than the carrier.

WE DO NOT WARRANT, REPRESENT, OR GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. Nothing in these Terms excludes or limits the Seller’s liability toward a Consumer to the extent that such exclusion or limitation is prohibited by mandatory law, in particular with respect to conformity of goods with the contract and liability for personal injury or damage.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Atelier Silver Mouse, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THE SHOPIFY PLATFORM AND ITS AFFILIATES, BE LIABLE FOR ANY LOSSES, CLAIMS, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, COSTS OF REPLACEMENT, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS RESULTING FROM THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING BUT NOT LIMITED TO ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCTS) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 17 — INDEMNIFICATION
If, as a result of the User’s culpable conduct, third parties bring claims against us related to the User’s violation of law or third-party rights while using the Services (for example unlawful content), the User agrees to cooperate with us in clarifying the matter. This provision does not limit any rights granted to Consumers under mandatory law.

SECTION 18 — SEVERABILITY
If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable part shall be deemed severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 19 — WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Services constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written (including, without limitation, any prior versions of the Terms of Service).

Contracts concluded through the Store are governed by Polish law. The choice of law does not deprive the Consumer of the protection granted by provisions that cannot be excluded by agreement and that apply in the country of the Consumer’s habitual residence.

The headings used in this agreement are included for convenience only and shall not limit or otherwise affect these Terms.

The Consumer has the option of using out-of-court methods of handling complaints and pursuing claims (ADR). Information on available procedures and entities authorized to conduct ADR proceedings may be obtained in particular from municipal or district consumer ombudsmen and on the websites of competent consumer protection institutions. The use of ADR is voluntary.
